Eli Llily to pay more than $1 billion to federal and state governments for Psych Drug Zyprexa?
















Eli Lilly and federal prosecutors are discussing a settlement of a civil and criminal investigation into the company’s marketing of the antipsychotic drug Zyprexa that could result in Lilly’s paying more than $1 billion to federal and state governments.

If a deal is reached, the fine would be the largest ever paid by a drug company for breaking the federal laws that govern how drug makers can promote their medicines.

Several people involved in the investigation confirmed the settlement discussions. They insisted on anonymity because they have not been authorized to talk about the negotiations.

Zyprexa has serious side effects and is approved only to treat people with schizophrenia and severe bipolar disorder. But documents from Lilly show that between 2000 and 2003, Lilly encouraged doctors to prescribe Zyprexa to people with age-related dementia, as well as people with mild bipolar disorder who had previously been diagnosed only as depressed.

Although doctors can prescribe drugs for any use once they are on the market, it is illegal for drug makers to promote their medicines any uses not formally approved by the Food and Drug Administration.

Lilly may also plead guilty to a misdemeanor criminal charge as part of the agreement, the people involved with the investigation said. But the company would be allowed to keep selling Zyprexa to Medicare and Medicaid, the government programs that are the biggest customers for the drug. Zyprexa is Lilly’s most profitable product and among the world’s best-selling medicines, with 2007 sales of $4.8 billion, about half in the United States.

Lilly would neither confirm nor deny the settlement talks.

“We have been and are continuing to cooperate in state and federal investigations related to Zyprexa, including providing a broad range of documents and information,” Lilly said in a statement Wednesday afternoon. “As part of that cooperation we regularly have discussions with the government. However, we have no intention of sharing those discussions with the news media and it would be speculative and irresponsible for anyone to do so.”

Lilly also said that it had always followed state and federal laws when promoting Zyprexa.

The Lilly fine would be distributed among federal and state governments, which spend about $1.5 billion on Zyprexa each year through Medicare and Medicaid.

The fine would be in addition to $1.2 billion that Lilly has already paid to settle 30,000 lawsuits from people who claim that Zyprexa caused them to suffer diabetes or other diseases. Zyprexa can cause severe weight gain in many patients and has been linked to diabetes by the American Diabetes Association.

Prescriptions for Zyprexa have skidded since 2003 over concerns about those side effects. But the drug continues to be widely used, especially among severely mentally ill patients. Many psychiatrists say that it works better than other medicines at calming patients who are psychotic and hallucinating. About four million Zyprexa prescriptions were written in the United States last year.

Federal prosecutors in Philadelphia are leading the settlement talks for the government, in consultation with the Department of Justice headquarters in Washington. State attorneys general’s offices are also involved. Lawyers at Pepper Hamilton, a firm based in Philadelphia, and Sidley Austin, a firm based in Chicago, are negotiating for Lilly.

Nina Gussack, who is representing Lilly at Pepper Hamilton, said she could not comment on the case. Joseph Trautwein, an assistant United States attorney in the Eastern District of Pennsylvania, also declined to comment.

While a settlement has not been concluded and the negotiations could collapse, both sides want to reach an agreement, according to the people involved in the investigation. Besides the escalating pressure of the federal criminal inquiry, Lilly faces a civil trial scheduled for March in Anchorage, Alaska, in a lawsuit brought by the state of Alaska to recover money the state has spent on Zyprexa prescriptions. A loss in that lawsuit would damage Lilly’s bargaining position in the Philadelphia talks.

While expensive for Lilly, the settlement would end a four-year federal investigation and remove a cloud over Zyprexa. While Zyprexa prescriptions are falling, its overall dollar volume of sales is rising because Lilly has raised Zyprexa’s price about 40 percent since 2003.

Federal prosecutors have been investigating Lilly for its marketing of Zyprexa since 2004, and state attorneys general since 2005. The people involved in the investigations said the inquiries gained momentum after December 2006, when The New York Times published articles describing Lilly’s multiyear efforts to play down Zyprexa’s side effects and to promote the drug for conditions other than schizophrenia and severe bipolar disorder — a practice called off-label marketing.

Internal Lilly marketing documents and e-mail messages showed that Lilly wanted to convince doctors to prescribe Zyprexa for patients with age-related dementia or relatively mild bipolar disorder.

In one document, an unidentified Lilly marketing executive wrote that primary care doctors “do treat dementia” but leave schizophrenia and bipolar disorder to psychiatrists. As a result, “dementia should be first message” to primary-care doctors, according to the document, which appears to be part of a larger marketing presentation but is not marked more specifically. Later, the same document says that some primary care doctors “might prescribe outside of label.”

In late 2000, Lilly began a marketing campaign called Viva Zyprexa and told its sales representatives to suggest that doctors prescribe Zyprexa to older patients with symptoms of dementia.

The documents were under federal court seal when The Times published the articles, and Judge Jack B. Weinstein of Federal District Court in Brooklyn rebuked The Times for publishing them.

The settlement negotiations in Philadelphia began several months ago, according to the people involved in the investigation.

Last fall, the two sides were close to a deal in which Lilly would have paid less than $1 billion to settle the case, which at the time consisted only of a civil complaint.

Then Justice Department lawyers in Washington pressed for a grand jury investigation to examine whether Lilly should be charged criminally for its promotional activities, according to the people involved in the negotiations. A few days ago, facing the possibility of both civil and criminal charges, Lilly opened new discussions with the prosecutors in Philadelphia.

I hope that this happens as I want these people to understand the horrors that they are doing to others... Money is not a problem for them but... It is a statement that the USA is not going to take there BS anymore...

The "deadly" truth about opiates

I know that I have been spending a lot of my time writing about drugs etc recently, but I feel that this is a responsibility that I must take on as I have been working at a medical detox facility in Florida called Novus and we get people off drugs.

The most prevalent drugs that I see in people coming to get clean are the use of "legal" opiates and some illegal as well. Oxycodone (Percodan), Hydrocodone (Vicodin), Raw Opium, Opium, Codeine, Morphine, Heroin, Hydromorphone (Dilaudid), Methadone (Dolophine) and the list goes on...

"Possible" Effects of Opiates

I put the above in parenthesis as I see these things happening all the time when people are coming off drugs and it is NOT fun for the user at all and so to me it should be classed as more than just "possible" effects...

General effects of narcotic analgesics include: sedation, slowed reflexes, raspy speech, sluggish "rubber-like" movements, slowed breathing, cold skin, and possible vomiting. However, as a user continues to abuse narcotic analgesics he or she will build a tolerance to the drug, therefore causing the effects to diminish. Heroin, a very strong narcotic depressant, completely destroys the users ability to reason. Its synthetic form, known as "designer drug" has been proven to be even more deadly and addictive. If the abuser wishes to maintain the same effect, he or she will have to take steadily larger doses as the tolerance develops.

Heroin users generally experience certain psychological effects immediately after injection. These include a feeling of euphoria: relief from withdrawal symptoms: and, relief from pain. Physical effects, if they are evident at all, typically will become evident after 15-30 minutes. Physical effects may not be evident if the user is tolerant and has taken a normal dose. With new users, the physical effects include: nodding off, poor motor coordination, depressed reflexes, and slow breathing.

If a user is addicted to opiates he or she will suffer withdrawal symptoms if they don't receive another dose, or "fix", before the drug is completely out of their system. Withdrawal effects can be chills, aches of the muscles and joints, nausea and insomnia. These symptoms normally start 4-6 hours after the last dosage of the drug. The withdrawal signs and symptoms intensify from 14-24 hours following the injection, and may be accompanied by gooseflesh, slight tremors, loss of appetite and dilation of the pupils. Approximately 24-36 hours since the last "fix", the addict experiences insomnia, vomiting, diarrhea, weakness, depression and hot/cold flashes. Withdrawal signs and symptoms generally reach their peak after 2-3 days. At this point, the addict usually experiences muscular and abdominal cramps, elevated temperature and severe tremors and twitching. This twitching, especially of the legs, is referred to in the expression "kickin' the habit". The addict is very nauseated at this time, may gag and vomit repeatedly, and may lose 10-15 pounds within 24 hours.

Signs of an overdose of narcotic analgesics are depress respiration, slow and shallow breathing, clammy skin, convulsions, possible coma and death.

So I know that that your friends might tell you how cool it is and if your doing it yes you might enjoy the "high" BUT when you decide to stop it is going to be an extremely wild and un-fun ride so why get into it into the first place...

So I hope that you can use this information in your life as I see a lot of people that I work with do not realize just how hard it is to get off these legal and illegal opiates.

Jason Lee — Skateboarder, Actor and Scientologist

Jason Lee was born on April 25, 1970 in Orange, California. He is a professional skateboarder and has been for years, particularly in the late 80s and early 90s.

He since has been focusing his career in acting and doing quite well at that.

He currently stars in as Earl Hickey in “My Name is Earl”, which is an extremely popular tv show on NBC.

Jason Lee has also been in numerous well-known movies, including Vanilla Sky (with Tom Cruise), Almost Famous, Enemy of the State (with Will Smith), A Guy Thing (with Julia Stiles), Heartbreakers (with Jennifer Love Hewitt), Dogma, Chasing Amy (with Ben Affleck) and Mallrats, among others.

Jason Lee was also nominated for a Golden Globe award for Best Actor in a Television Series — Musical or Comedy.

Australian-born actor Heath Ledger, 28, the co-star of the Oscar-winning movie "Brokeback Mountain," was found dead in a New York residence on Tuesday...

Today has been a sad day for Hollywood and all who liked Mr Heath Ledger. I am putting this on my Blog as I really thought that this actor was very good and was well respected and loved by many but also the fact that i have heard (and I dont know if this is actually true) that it seems he might have overdosed... I just wanted to let this be known as he was a very good actor and was starting to become very big and had a lot of potential...

So take this to heart and stay away from drugs - and when I say that I mean both illegal contraband as well as these psychiatric drugs that are passed out avidly like candy nowadays...

My point is - Don't end up like this amazing person... just because you are not "famous" does not mean that you cant also be fucked over by the drugs that are out there.

Tom Cruise "Biography" by Andrew Morton

Hello again... I am sure that most of you have heard of this quote on quote Biography on Tom Cruise by Andrew Morton... I have been reading the different "facts" that it is spreading and as I am a Scientologist and have been for 24 years and since I did work as part of the church for 9 years I can honestly say that this is just a bunch of BS.

Citizens Commission on Human Rights

Good day, I just wanted to let you in on something that I found recently that I was impressed by and this was that there were several Public Service announcements that were done by the Citizens Commission on Human Rights (CCHR) and I watched them and found them very eye opening in that it was going over what the psych drugs do to people and what the "side effects" can be.

I must make you aware of the fact that I actually work at a drug detox center and see daily the people that are coming off these drugs. There are people that come there that are ONLY addicted to legally prescribed psychiatric drugs and this too me is insane. Well I am doing my part daily to help the people of this planet rid themselves of the dependency to these and other harmful drugs so please at least look at the top of my blog and view the videos that I have put up there as to me they are very important...

Picking your friends

I just wanted to say something on the subject of picking friends etc... The reason that I say this is that I recently was in California working there and when i was there I learned some interesting things about friends and the ones that I used to pick or be apart of. You see it really does not matter how cool they are or how much money they make etc as the one things that I have learned in the 24 yrs of being on this planet we call home is that you MUST learn to judge people by there actions. I used to not apply this to my own life but could see it in others and would try to tell them this but it did not work as well as I myself did not fully use it in my own life - Sort of "Do as I say and not do as I do" I have recently started applying this to whom I am in contact and I really appreciate it as I am doing a lot better financially now as well as mentally.

What it seems to come down to is that there are 3 methods that a person uses in the handling of others. I recently read a book called "Science Of Survival" by L. Ron Hubbard and I really liked it and I wanted to share something out of that as I think if we used this in life at large you would really be unstoppable in terms of your dreams and ambitions. I will now quote from this book so you can read it exactly as I did.

"The methods of handling others could assigned to three general categories. The highest category would be one of enhancement, where the individual seeks by example and good reasoning to lift the level of those around him to the point where they will partake of the projects of living with him."

This is quite simply the generally nice and warm hearted people that are around you that you would genuinely like.

"The second category would be that of punishment drive. Here the individual uses alarm, threats and the general promise of pain unless compliance is given by the others around him."

"The third category is that of nullification, wherein the individual seeks to minimize individuals to be more than they and so be able to control them. This category would rather see a man sick than well, because sick men are less dangerous then well men according to the "thinking" that takes place in this band"

So this is what I read and I do believe that if everyone actually applied this to their life and choose their friends, colleagues, girlfriends, boyfriends, husbands, wife's etc with this data in mind and actually see HOW someone handles others and then can get a true overall picture of how this person is. The first category would be a good person to be "hooked up" with but the next two would not. So I think that you should do this for yourself and find someone that you know that you do not already have fixed thoughts about them and just LOOK and Watch how they act to others... Do they bring them up or do they bring them down... If you could master this then you could pick the correct person every time to be connected with.

The above referenced book "Science of Survival" is a great read and also is much more in depth in the ways that people act and I guarantee if you were to read this book you would be set in life so that you knew when talking to people if they were honest or not etc.... And I don't know about you but information like that is worth a lot more than the $10 - 15 that the book costs... Now - one thing that I must say, if you immediately thought that your boss fit this then you could be correct but I also am willing to bet there are undisclosed transgressions that you are doing at your work place that the boss does not know about that would make you feel this disposition towards him/her. It IS entirely possible that he is someone that brings people "down" per say in order to get his job done but just make sure of this...

The subject of transgressions is a whole other kettle of fish which I will cook up some other time...

I hope that this data can be useful to you. I might only be 24 yr old skateboarder but if I stumble upon amazing truths I think it would be selfish to hoard it all to myself. :)

The world today

Hello, This weekend I have been reading the media from around the world and I just wanted to say that I think that it is pretty sad that the news agencies can manufacture data and spread it around as if it is factual information. I mean to tell you the truth sometimes I see things that I KNOW are not correct but somehow since CNN or MSNBC is saying it, I almost tend to believe it... So I just wanted to advise you that you really should evaluate all the data that you see out there as some is for the good and some is just out there to injure... Anyways it's a gorgeous day and am going to go take advantage of it and go for a good skate... See ya.
